Data Physics Corporation, a manufacturer of vibration testing equipment and systems, has filed suit against Qualmark Corporation and its subsidiary Qualmark Ling Corporation (collectively “Qualmark”), in Santa Clara, California on numerous counts. Data Physics alleges, among other things, that Qualmark has committed unfair business practices, trade libel, unfair competition, and interference with Data Physics’ economic advantage. Data Physics also seeks cancellation of Qualmark’s California state trademark registration to the name LING ELECTRONICS because of its widespread and unregulated use in the vibration testing equipment field for over 50 years. Additionally, Data Physics incorporated its own Ling Electronics subsidiary almost three years prior to Qualmark’s registration of the trademark.
Data Physics’ complaint notes that Qualmark Ling’s shaker operations have passed through three different owners in the last decade and that the quality and know-how once associated with the Ling name have been seriously degraded. Many employees from previous Ling operations now apply their unique knowledge and experience manufacturing shaker products and parts for Data Physics and its customers.
Sri Welaratna, Data Physics President and Chief Executive Officer, states that “An increasing part of our business is devoted to service and maintenance of the large installed base of Ling shakers offered by a number of companies over the last fifty years. Because of the specialized knowledge and skills of Data Physics employees, we believe no other company can match our expertise in manufacturing and servicing Ling-compatible vibration test equipment.”
